Subject to the Terms and Conditions set out below, eligible Rewind customers that subscribe to Rewind Backups will receive a free pair of Apple AirPods or CAD$200 Amazon gift card!
1. Definitions
“Customer Account” has the meaning given to this term in the Terms of Service;
“Eligible Customers” means a customer who meets all the following criteria:
a. Is a business operating in, or a permanent resident of Canada (including Quebec), or a business operating in, or a permanent resident of the United States of America. Residence is determined by the jurisdiction (province or territory) where a client has their primary tax filing obligation based on their regular place of residence;
b. Currently has or has previously had a Rewind Plan with us;
c. Has been a paying customer for a minimum of three (3) months; and
d. Has submitted a valid deliverable email address to us via the offer form provided in the applicable offer email;
“Promotional Offer” means the offer as defined in section 1;
“Promotional Period” means the period starting at 12:00:00AM EST on October 1, 2020 and ending at 11:59:00 PM EST on November 30, 2020;
“Qualifying Criteria” means the conditions set out in section 2 below.
“Rewind Backups Plan” means the subscription plan payable by the Customer for the use of Rewind Backups.
“Subscription Period” means the length of time that any one Customer is subscribed to the Rewind Backups Plan.
“Services” has the meaning given to this term in the Terms of Service;
“Terms” mean these terms and conditions that govern this Promotional Offer;
“you” and “your” mean any Eligible Customer;
“we”, “us”, “our” and “Rewind.io” means Rewind Software Inc., doing business as Rewind.
2. The Promotional Offer
Provided you fulfill the Qualifying Criteria in Section 3 and the conditions set out in Section 4 below, you may elect to receive the following:
(a) Complimentary Apple AirPods with charging case (Model # MV7N2AM/A) with an approximate value of CAD$219; or
(b) Complimentary Amazon Gift Card, worth CAD$200.00.
(subject to availability at time of selection; see additional terms and conditions below; each item individually referred to as the “Reward”).
3. Eligibility Criteria:
To qualify for this Promotional Offer you must:
(a) be an Eligible Customer, as defined in Part A above; and
(b) subscribe to Rewind Backups Plan [https://apps.shopify.com/backup] during the Promotional Period, and no later than 11:59:00 PM Eastern Time on November 30, 2020;
The Subscription Period for your Rewind Backups Plan must be for a minimum period of three months. You will only qualify for this Promotional Offer following the completion of this three-month Subscription Period.
4. Conditions that apply to the Promotional Offer
The following conditions also apply to this Promotional Offer:
(a) The Promotional Offer is available to the first fifty (50) Eligible Customers only.
(b) Only one Reward per Eligible Customer;
(c) The Reward is only available while supplies last. While we reserve the right to substitute the Reward with an offer of equal value, we are not obligated to do so.
(d) Eligible Customers are not entitled to a change, upgrade or substitution of the Reward upon selection.
(e) Your subscription to Rewind Backups must continue for a minimum period of three (3) months;
(f) In order to select and receive the Reward, you must have a valid deliverable email address associated with your Customer Account by November 30, 2020. It is your responsibility to ensure that the email associated with your Customer Account is valid;
(g) Starting on this date, we will notify you of the Promotional Offer by way of an email sent to the email address associated with your Customer Account. The message will contain a secure link that will permit you to visit a secure online site where you can select your Reward and confirm an address for delivery, as well as any other shipping details;
(h) We will ship the Reward to the address you provide when you selected the Reward, as long as it is an address with a civic number and street name and is located anywhere in Canada or in the United States of America. We will not ship to any post office box (P.O. Box);
(i) We may send you an email notification informing you that your Reward has been shipped and/or providing you with a tracking number. It is your responsibility to keep your email address current. If a tracking number has been provided, it is your responsibility to track and make any arrangements necessary to receive delivery of the Reward;
(j) A signed receipt of delivery at the address you provided when you selected your Reward, will be sufficient evidence of your receipt of the Reward, regardless of whether the signature on the receipt corresponds to a signature that appears in our records for the Customer Account.
(k) We are not responsible for any failure, malfunction or defect in the Reward itself, nor for any services related to it. Any complaint, enquiry, or communication related to any failure, malfunction or defect in the Reward, as well as any services related to it, should be addressed directly to the manufacturer.
5. Additional Terms and Limitations
(a) The Promotional Offer and these Terms do not, in any way, affect any of the service fees related to the operation of any of our Services, which continue to apply.
(b) The Promotional Offer shall not be combined with any other of our other offers or promotions – unless otherwise indicated at our sole discretion.
(c) We reserve the right to change the Promotional Offer and these Terms at any time. The posting of the current Terms at this link shall be deemed sufficient notice to you of such Terms and any changes, if required.
(d) We reserve the right to cancel the Promotional Offer at any time for any reason at our complete discretion without notice.
(a) In the event of a conflict between these Terms and the content of any document, brochure or promotional material advertising the Promotional Offer, these Terms shall prevail. You may always view the current Terms by visiting this link or you may email sales@rewind.com to request a current copy.
(b) We reserve the right, in our sole discretion, to suspend, disqualify, limit or revoke this Promotional Offer to any person or account holder we find or believe to be manipulating or otherwise abusing the process, fairness, integrity or operation of the Promotional Offer, including any person whose overall client relationship with us is in our opinion not in good standing.
(c) By redeeming this Promotional Offer, you hereby hold harmless Rewind.io from any and all liability for any injuries, loss or damage of any kind to you or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any promotional item.
